Scope
These Terms and Conditions apply to all orders placed through the online shop. Conflicting terms are not recognised unless we expressly agree to them. Mandatory statutory provisions remain unaffected.
Conclusion of contract and ordering process
The presentation of products in the online shop does not constitute a binding offer, but a non-binding invitation to order.
The ordering process involves the following steps: selecting items and adding them to the cart, opening the cart, entering delivery and billing details, choosing shipping and payment methods, reviewing all details on the order summary, and completing the order by clicking the “order with obligation to pay” button. By submitting the order, you make a binding offer to conclude a purchase contract.
Before submitting the order, you can review and correct all entries at any time using the usual keyboard and mouse functions and your browser’s back button.
We confirm receipt of your order without delay by electronic means. This confirmation of receipt does not constitute acceptance of your offer. The contract is concluded only through our express declaration of acceptance or by shipping the goods.
Contract language
The contract can be concluded in German and English.
Storage of the contract text
We store your order data and send it to you by email with the order confirmation. The Terms and Conditions in force at the time of your order can be viewed, saved, and printed on this page at any time.
Products
The online shop offers, in particular, the following goods: fragrances, care products, accessories, textiles, tea, and gift items.
Prices and shipping costs
All prices include statutory VAT. Shipping costs are shown separately during checkout and are paid by the customer unless agreed otherwise.
Available payment methods include, in particular: Shopify Payments, Klarna, and PayPal.
Payment terms
Payment is made using the methods offered in the online shop. In the event of late payment, statutory default interest applies.
Reminder and collection costs
In the event of late payment, necessary and reasonable reminder and collection costs are to be reimbursed within the limits of the statutory provisions.
Delivery
We deliver within Austria, the European Union, and Switzerland.
If an item is unavailable, you will be informed accordingly.
For deliveries to non-EU countries (e.g. Switzerland), additional costs such as import VAT, customs duties, or fees may apply and are to be paid by the customer. Prices shown for deliveries to Switzerland are exclusive of VAT (net export).
Delivery dates are non-binding unless expressly agreed otherwise. Delays caused by shipping providers, customs, or unforeseeable events are beyond our control.
Address details and delivery
The customer is obliged to provide a complete and correct delivery address. We do not check the content of the address details.
If delivery cannot be made due to incomplete or incorrect details, or if a shipment is not accepted or not collected in time, this falls within the customer's responsibility.
If a shipment is returned to us in such cases, we reserve the right to charge for the costs incurred as well as for re-shipping. The actual return costs incurred are generally around €25.
Any refund is issued less the shipping and return costs actually incurred.
Right of withdrawal
As a consumer within the meaning of the Austrian Consumer Protection Act (KSchG), you have the right to withdraw from the contract within 14 days without giving any reason. The period begins on the day you, or a third party named by you other than the carrier, take possession of the goods — or, for multiple goods in a single order or for partial deliveries, the last item. To exercise it, a clear statement before the deadline is sufficient. The easiest way is the withdrawal form on our online return page; alternatively, an informal statement — for example by email to shop@duftundkultur.at — is sufficient. A model withdrawal form is available on our website.
Consequences of withdrawal
In the event of withdrawal, all payments including standard delivery costs are refunded to the original payment method. We may withhold the refund until the goods have been returned or proof of return has been provided.
Return
The goods must be returned within 14 days of the withdrawal declaration. The customer bears the cost of return unless the delivery was incorrect or defective.
Condition of the goods
Returns are only possible in unopened, originally sealed condition. For sealed goods that are not suitable for return for reasons of health protection or hygiene, the right of withdrawal lapses once the seal has been removed.
Return processing
A return is initiated using our online return form or by email to shop@duftundkultur.at.

Warranty
The statutory warranty provisions apply. For consumers, the warranty period is two years from delivery of the goods.
Product liability and damages
Liability applies within the framework of the statutory provisions. Claims for damages are governed by the statutory provisions.
Retention of title
The goods remain the property of the company until payment has been made in full.
Images
Product images are for illustration. Minor deviations in colour, presentation, or finish are possible.
Pricing errors
Obvious pricing or product errors are reserved. In such cases, we reserve the right to withdraw from the contract.

Dispute resolution
We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
Choice of law and place of jurisdiction
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For businesses, the company's registered office is the place of jurisdiction. Mandatory consumer protection provisions remain unaffected.
Final provisions
Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
